1. Introduction

1.1. These Terms of Use describe the way in which you may use the Sysdom website (www.sysdom.com), and the way in which Sysdom will operate the Service. By using the services offered by Sysdom, you agree to be bound by these Terms of Use and to abide by the Privacy Statement

1.2. Sysdom may change the Terms of Use at any time. Sysdom will notify you of any changes by e-mail or through a notice published on the Sysdom website. By using the Sysdom website after being notified of the change, you are agreeing to be bound by the new Terms of Use. If you do not agree to the change you must terminate your membership by e-mailing us on support @ Sysdom.com

1.3. Terminating membership does not relieve you of any obligations you have accrued, including payment of any charges due in connection with use of the Sysdom website or entitle you to a refund of any membership fees paid.

2. Membership

2.1. You must sign up as a member and pay the appropriate annual membership fee before using the services offered by the Sysdom website.

2.2. Your membership details must be true and correct.

2.3. If at any time your details change then you agree to notify us immediately by e-mailing the changes to support @ Sysdom.com

2.4. Sysdom reserves the right to decline membership and access to Sysdom’s services.

3. Personal Information

3.1. Sysdom will respect the privacy of your personal information and undertakes to comply with all applicable Data Protection legislation.

3.2. You agree that Sysdom may use your personal information in accordance with the purposes for which Sysdom obtained your permission at membership sign up and in accordance with the Privacy Statement.

4. Service Obligations

4.1. The services of the Sysdom website are provided without any warranties or guarantees unless otherwise specifically stated.

4.2. Sysdom agrees to use its best endeavours to ensure that your Sysdom website is fully operational. As Sysdom cannot guarantee that this will always be the case, it does not accept liability for any defects which may exist, or for any economic losses, loss of revenues or profits, loss of goodwill or reputation or consequential losses you may suffer which arise from your use of your Sysdom website or your inability to access your Sysdom website.

4.3. The Sysdom website and service is not intended to be used as an online backup facility. Although Sysdom takes every precaution to protect the material you have entered or uploaded to the Sysdom website, you should not rely on the Sysdom website as your only source for this material. You should backup copies of any images or material you have entered and uploaded to the Sysdom website.

4.4. Sysdom may offer or promote products and services in cooperation with other companies. If you purchase such products or services directly from other parties, then your contractual relationship is with the company from which you have purchased the product or service. Should any dispute arise between you and the company, Sysdom takes no responsibility for its settlement, or for any loss or damages that you may incur arising from such dispute.

4.5. The Sysdom website may contain links to other websites. Sysdom is not responsible for the content of external internet sites.

4.6. At its discretion Sysdom reserves the right to remove any images or material on your Sysdom website and/or to suspend, restrict or terminate your access to your Sysdom website at any time.

4.7. We reserve the right to forward any images or material uploaded to the Sysdom website by you, together with your personal details if required, to the police or other regulatory authorities, where requested by them to do so or to a third party where ordered to do so by a Court Order.

5. Using the Service

5.1. You may not upload, or permit others to upload, material to your Sysdom website if that material infringes or violates the rights of others, contains any offensive language or images, or anything which is obscene, pornographic, misleading, deceptive, threatening, harassing or defamatory.

5.2. You are responsible for the content of photos posted by you on your Sysdom website and agree to indemnify, defend and hold harmless Sysdom, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to your Sysdom website from and against any or all losses, expenses, damages and costs including legal fees resulting from any violation of these Terms of Use, or any activity relating to your account by you or any other person accessing your Sysdom website through your account.

5.3. You agree that you will only use the Sysdom website in a manner that is consistent with these Terms of Use and in a way that complies with all applicable laws and regulations.

5.4. All fees and charges incurred for use of the Sysdom service will be charged to your credit card as currently held in our records. You may change the credit card information at any time. If at any time a credit card charge is refused, Sysdom reserves the right to suspend or terminate your membership, but you will still be responsible for any outstanding fees or charges.

5.5. You will be notified by e-mail of any changes to the Sysdom fees. The Prices section of the website will also be updated with these changes.

5.6. The annual fee for the Sysdom website includes the cost of registration for a .co.uk domain or the FREE transfer of an existing domain and subsequent renewal when it becomes due. Costs for domains other than .co.uk can be found in the Prices page of www.Sysdom.com.

5.7. You will be responsible for the providing all ancillary computer equipment, telephone and other equipment and services in order to access your Sysdom website and services.

5.8. You are responsible for maintaining the secrecy of your password and are responsible for any use of it. You must notify us immediately with regard to the theft or loss of your password.

5.9. High Resources Usage – Sysdom websites offer unlimited use of its server resources, where resources are defined as bandwidth, processor utilisation or disk space. In rare cases, Sysdom may find a customer to be using excessive resources to such an extent that they may jeopardise service performance and resources for other customers. In such instances, and at Sysdom's discretion, Sysdom reserves the right to suspend that Sysdom website immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of Sysdom’s services. Customers may be offered an option whereby Sysdom continues supplying the Sysdom website under reduced usage criteria or at additional cost specified by Sysdom. Failure to comply with such measures may result in membership being terminated and the Sysdom services removed.

6. Copyright

6.1. You must own all copyright or have the express permission of the copyright holder for all the pictures and material that you upload to your Sysdom website. You may not upload or display any images or material on your Sysdom website to which you have no rights.

6.2. You retain all copyright for the images and materials uploaded to your Sysdom website. You hereby grant Sysdom a licence to display these images and material, free of charge, on your Sysdom website as part of the service.

6.3. You acknowledge that, with the exception of any images or material uploaded and displayed by you on your Sysdom website, any intellectual property in the remaining content of your Sysdom website belongs to Sysdom.

Acceptable Use Policy (AUP)

This AUP applies to your use of your Sysdom website. You will be responsible for your own Sysdom website and for the legal and regulatory compliance of your website, and with all applicable laws and regulations. You must not use your website for any illegal purpose or to advertise or sell illegal products or services.

The following activities and material are not permitted on your Sysdom website:

  • Using your website in any manner that is illegal or libellous.
  • Storing or distributing material (including software) that infringes the owner's copyright, trademark or patent.
  • Use of unlicensed software. Sending unsolicited commercial email.
  • Running Internet Relay Chat (IRC) servers or 'bots'.
  • Pornography and other sexually explicit material.
  • Promoting prostitution or similar services.
  • Hosting sites promoted by means of email or newsgroup spamming.
  • Promoting services or software that assist in the distribution of unsolicited commercial email.
  • Unauthorised probing, scanning or testing the vulnerability of other systems.
  • Unauthorised monitoring of data or traffic on any system.
  • Interference with internet services, including attacks by mass mailing and flooding.
  • Transmission of any material that threatens or encourages harm or destruction of property or people.
  • Transmission of any material that harasses another person.
  • Posting of defamatory, scandalous, or private information about a person without their consent.
  • Making fraudulent offers to sell or buy products, items or services.
  • Activities amounting to forgery or impersonation.

If you use your Sysdom website to sell goods or services, you must comply with all relevant e-commerce legislation, including the Electronic Commerce (EC Directive) Regulations 2002, the Consumer Protection (Distance Selling) Regulations 2000 and other applicable consumer protection or other legislation.
